Draft document. This text is a general draft awaiting legal review. It is not yet legally binding and may change.

1. Purpose

This Acceptable Use Policy ("AUP") describes what you may not do with Fluxus Cloud services, including VPS hosting and any infrastructure we manage for you. It protects our customers, our network and the wider internet. It forms part of our Terms of Service.

2. Prohibited activities

You must not use our services, or allow others to use them, to:

  • break any law or regulation, or help others do so;
  • send unsolicited bulk email (spam), or host websites advertised through spam;
  • distribute malware, viruses, ransomware or other harmful software;
  • run phishing, fraud or scam operations, or impersonate others;
  • attack, scan, probe or attempt unauthorised access to any system or network, including denial-of-service attacks;
  • operate open proxies, open mail relays or anonymising services that are used for abuse;
  • store or distribute content that infringes copyright, trademarks or other intellectual property rights;
  • host content that is illegal, sexually exploits minors, promotes violence or terrorism, or harasses others;
  • mine cryptocurrency, unless we have agreed to it in writing;
  • use resources in a way that degrades service for other customers.

3. Security responsibilities

You are responsible for securing the servers and applications you control, including keeping software up to date, using strong credentials and responding to security issues. On managed plans, we share these responsibilities as described in your plan or Order.

4. Reporting abuse

To report abuse involving our network or a server we host, email [email protected] with as much detail as possible, such as IP addresses, timestamps, logs and email headers.

5. Enforcement

If we believe this AUP has been breached, we may, depending on the seriousness of the breach:

  • contact you and ask you to fix the issue;
  • restrict or suspend the affected service, without prior notice where there is an immediate risk;
  • terminate your service;
  • report illegal activity to the relevant authorities and co-operate with lawful requests.

Suspension or termination for breach of this AUP does not entitle you to a refund or service credits.

6. Changes

We may update this AUP to address new types of abuse. The "Last updated" date at the top shows when it last changed.
